Monthly News Updates: International Criminal Court News Updates – May 2022

Throughout May the ICC continued strengthening cooperation.  The Office of the Prosecutor announced a new initiative to strengthen engagement with civil society, and with the support of the Netherlands sent its largest field deployment to Ukraine.  The ICC along with Senegal held a conference promoting international criminal justice.  

INTERNATIONAL CRIMINAL COURT

New Members in the ICC Advisory Committee on Legal Texts

The ICC Advisory Committee on Legal Texts has six members and its three judicial members are elected every three years.  The ICC President announced the newly elected judicial members are Judge Chang-ho Chung, Judge Tomoko Akane, and Judge Gocha Lordkipanidze.  The Committee is responsible for making and reporting on amendment proposals to the Rules of Procedure and Evidence, the Elements of Crimes, and the Regulations of the Court. [May 20, 2022].

New initiative to strengthen the ICC’s civil society engagement

ICC Prosecutor Karim A.A. Khan announced that the Office of the Prosecutor (OTP) is launching a new initiative to increase civil society’s role in the Office’s work.  This is in response to civil society asking the OTP for further opportunities to work in collaboration with the ICC.  The initiative includes roundtables with NGOs, guidance materials for engaging with victims, and increased field engagement with local civil society organizations.  The first roundtable is planned for this June. [May 13, 2022] 

ICC holds training for ICC Counsel

On April 25 and 26, the ICC held training sessions over two days for over 200 lawyers registered on the ICC List of Counsel.  The sessions included training on team management, legal team technical support, ethics and disciplinary proceedings, and participation of witnesses and victims.  Participants also received updates on current ICC cases and key legal issues. AFRICA

Republic of Senegal | ICC holds Regional Conference in Senegal

On May 23 to 25, the ICC, with cooperation of Senegal, hosted a regional conference with 190 attendees. Attendees included high level officials from both the ICC and Economic Community of West African States (ECOWAS), as well as Senegal, Chad, and the Central African Republic.  The conference discussed building a stronger international criminal justice system and increasing cooperation between the ICC and states particularly from ECOWAS. [May 25, 2022]

Central African Republic | Deputy Prosecutor Mame Mandiaye Niang

Attends opening of the Special Criminal Court of the Central African Republic

ICC Prosecutor Karim A.A. Khan announced the Office of the Prosecutor’s support of the Special Criminal Court of the Central African Republic after the opening of the first trial.  Prosecutor Khan emphasized the need for complementarity and cooperation between the ICC and national court systems.  Deputy Prosecutor Mame Mandiaye Niang attended the opening trial and expressed the importance of building rule of law and that the ICC is a court of last resort. [May 11, 2022]

EUROPE

Ukraine | ICC deploys 42 investigators and forensic experts to Ukraine
On May 17, the Office of the Prosecutor (OTP) deployed a 42 person investigation and forensics team to Ukraine.  The team will investigate crimes under the ICC’s jurisdiction and also help Ukrainian authorities.  This is the OTP’s largest field deployment, and was made possible through cooperation with the Netherlands. [May 17, 2022]

The ICC is increasing collaboration and cooperation. The ICC President visited the UN and Guinea-Bissau, the ICC Prosecutor visited Ukraine and Nigeria, and the Office of the Prosecutor is joining Eurojust to collect information for the Situation in Ukraine. 


INTERNATIONAL CRIMINAL COURT

ICC President completes mission to United Nations in New York City

ICC President Judge Piotr Hofmański undertook a three-day mission to the United Nations Headquarters in New York City.  During his mission, Judge Hofmański met with many UN officials, discussed the ICC’s growing number of activities, and promoted universal support of the Rome Statute. [April 7, 2022]


EUROPE

Ukraine | Office of the Prosecutor partners with the Joint Investigation Team

The ICC Office of the Prosecutor announced its participation in the Joint Investigation Team with Ukraine, Lithuania, and Poland regarding international crimes.  This marks the first cooperation and collaboration between the ICC and Eurojust (a European Union Agency).  The partnership allows for better and more efficient ability to collect information needed for the investigation into the Situation in Ukraine. [April 25, 2022].

Ukraine | ICC Prosecutor visits Ukraine

Beginning on April 13, ICC Prosecutor Karim AA Khan visited Ukraine to strengthen cooperation and engagement in the investigation into the Situation in Ukraine.  While there, he met with Ukraine’s Prosecutor-General Iryna Venediktova, visited the crime scene in Bucha saying there are “reasonable grounds to believe that crimes within the jurisdiction of the ICC are being committed,” and met with survivors in Borodyanka. [April 16, 2022]

United Kingdom | UK contributes £70,000 to the Trust Fund for Victims

The United Kingdom of Great Britain and Northern Ireland made a £70,000 voluntary contribution to the Trust Fund for Victims (TFV).  This contribution will specifically be used for victims of conflict relating to sexual and gender-based violence.  The TFV welcomed the contribution, and the UK reaffirmed their strong support of the ICC. [April 4, 2022] 


THE AMERICAS

Venezuela | Venezuela requests deferral of investigation, ICC Prosecutor requests resumption

Venezuela requested that the ICC Office of the Prosecutor (OTP) defer its investigation into the Situation in Venezuela under Article 18(2) of the Rome Statute.  Venezuela claims they are investigating the Situation domestically.  However, ICC Prosecutor Karim AA Khan claims there is no new information demonstrating this.  The Prosecutor has notified and requested that the Pre-Trial Chamber authorizes the OTP to resume the investigation. [April 21, 2022]

AFRICA

Nigeria | ICC Prosecutor visits Nigeria

The ICC Prosecutor Karim AA Khan concluded his first official visit to Nigeria.  The visit was conducted to discuss the preliminary examination into the Situation in Nigeria completed in 2020.  At that time, former ICC Prosecutor Fatou Bensouda concluded there were reasonable grounds that crimes against humanity and war crimes occurred.  The visit established cooperation between Nigeria and the ICC for any future investigation. [April 22, 2022]

Republic of Guinea-Bissau | ICC President visits Guinea-Bissau

ICC President, Judge Piotr Hofmański visited Guinea-Bissau and met with Umaro Sissoco Embaló, President of Guinea-Bissau, and other government officials to encourage ratification of the Rome Statute.  Judge Hofmański also visited the European Union Delegation in Guinea-Bissau. [April 21, 2022]

Sudan | Mr. Abd-Al-Rahman’s trial opens

On April 5, the case The Prosecutor v. Ali Muhammad Ali Abd-Al-Rahman opened before ICC Trial Chamber I.  Mr. Abd-Al-Rahman was charged with 31 crimes against humanity and war crimes, and he pled not-guilty to all.  ICC Prosecutor Karim AA Khan and ICC Senior Trial Lawyer Julian Nicholls made opening statements, followed by remarks from the Legal Representatives of Victims.  Prosecutor Khan emphasized the gender-based violence and crimes committed against children in this case and the ICC’s purpose to provide justice by this trial. [April 5, 2022]

Monthly News Updates: International Criminal Court – March 2022

The ICC Office of the Prosecutor opened the investigation into the Situation in Ukraine and submitted an application for arrest warrants in the Situation in Georgia.  Additionally, in the Situation in the Central African Republic II, the authorities of the Republic of Chad surrendered Mr. Mokom to the ICC.

INTERNATIONAL CRIMINAL COURT

Release of the fifth edition of the ICC Chamber Manual

The ICC released the fifth edition of the ICC Chambers Practice Manual.  The new edition adds a new section on the transmission of the records of the proceedings and a new model to provide directions for trial conduct.  The manual also includes a revised procedure for admission of victims’ applications to participate in all stages of proceedings. [March 25, 2022]

ICC issues statement for International Women’s Day

The ICC commemorated International Women’s Day by releasing a statement supporting “global action to advance gender equality and empowerment of all women and girls.”  The ICC described what the Court itself is doing to further promote women’s rights.  This includes taking a gender perspective in ICC proceedings and improving gender equality in ICC operations by appointing a Focal Point for Gender and working on a draft Strategy on Gender Equality and Workplace Culture. [March 8, 2022]

ICC Deputy Prosecutors sworn in

On March 7, Nazhat Shameen Khan of Fiji and Mame Mandiaye Niang of Senegal were sworn in as the ICC’s new Deputy Prosecutors.  They began their nine year term on March 8, 2022.  ICC Prosecutor Karim A.A. Khan welcomed the two new Deputy Prosecutors and remarked that this was an important step in the ICC Office of the Prosecutor revitalization process. [March 7, 2022]

EUROPE

Ukraine & Poland | ICC Prosecutor visits Ukraine and Poland

ICC Prosecutor Karim A.A. Khan visited Ukraine and Poland on March 16 and 17 with the purpose of supporting the investigation into the Situation in Ukraine.  Prosecutor Khan met with Ukraine’s Foreign Affairs Minister, Dmytro Kuleba,  Prosecutor-General,d Iryna Venediktova, and virtually met Ukrainian President Volodymyr Zelenskye. Prosecutor Khan also met with individuals who fled due to the hostilities taking place in Ukraine.  In Prosecutor Khan’s statement on the visit, he emphasized the difficulty of this investigation and requested voluntary financial contributions from ICC States Parties. [March 16, 2022]

Ukraine | Investigation into the Situation in Ukraine opens

The investigation into the Situation in Ukraine opened on March 2 after 39 ICC States Parties referred the Situation to the Office of the Prosecutor.  As of March 11, 41 ICC States Parties had referred the Situation of Ukraine to the ICC.  The Office of the Prosecutor’s investigation team is currently conducting the investigation on the ground.  To aid the investigation, the Office established a portal where anyone with relevant information may contact the investigators. [March 11, 2022]

Georgia | Prosecutor requests three arrest warrants regarding the Situation in Georgia

ICC Prosecutor Karim A.A. Khan filed an application for three arrest warrants for the Russian officials Lieutenant General Mikhail Mayramovich Mindzaev, Gamlet Guchmazov, and David Georgiyevich Sanakoev.  The Office of the Prosecutor determined there are reasonable grounds to believe that these individuals committed war crimes in Georgia in August 2008 in the context of an international armed conflict.  In Prosecutor Khan’s announcement, he drew parallels between the patterns of conduct observed in the Situation in Georgia and those emerging in the preliminary examination into the Situation in Ukraine. AFRICA

Central African Republic | Mr. Mokom surrendered to the ICC

On March 14, authorities of the Republic of Chad surrendered Maxine Jeoffroy Eli Mokom Gawaka to the ICC. The Pre-Trial Chamber II issued the warrant for his arrest in 2018 after finding reasonable grounds to suspect that Mr. Mokom committed war crimes and crimes against humanity in the Central African Republic between 2013 to 2014. On March 22, Mr. Mokum made his first appearance before the ICC. [March 22, 2022]

Monthly News Updates: International Criminal Court News Updates – February 2022

ICC Prosecutor Karim A.A. Khan released a statement clarifying the ICC’s jurisdiction in the context of the Ukraine-Russia Conflict.  The ICC also held several important hearings including the trial opening in the Gicheru case and the Defense’s appeal in the Ongwen case, which featured interventions from PILPG’s Michael Scharf, Milena Sterio, and Jonathan Worboys.

INTERNATIONAL CRIMINAL COURT

ICC Prosecutor issues a statement on the Situation in Ukraine

On February 25, ICC Prosecutor Karim A.A. Khan released a statement clarifying the ICC’s jurisdiction regarding the conflict occurring between Ukraine and Russia.  Prosecutor Khan highlighted the September 2015 declaration from Ukraine to the ICC.  In the 2015 declaration, Ukraine accepts the ICC’s jurisdiction for any crimes against humanity, genocide, and war crimes occurring on its territory beginning on February 20, 2014.  On February 28, Prosecutor Khan announced his Office is proceeding to gain authorization from the Pre-Trial Chamber to open an investigation into the Situation in Ukraine as quickly as possible. [February 28, 2022]

ICC Prosecutor issues a statement for International Day against the Use of Child Soldiers

ICC Prosecutor Karim A. A. Khan commemorated the International Day against the Use of Child Soldiers, by expressing his concern of the continued recruitment and use of children in hostilities.  He notes that child recruitment and use was at a record high in 2020, with 8,521 recorded incidents.  Prosecutor Khan emphasized that the Office of the Prosecutor is pursuing important steps to ensure accountability, but calls for continued action to protect children in situations of conflict. [February 14, 2022]

ICC Prosecutor attends 2022 African Union Assembly

On February 5-6, 2022, ICC Prosecutor Karim A.A. Khan attended the 35th Heads of State Summit of the African Union, which took place in Addis Ababa, Ethiopia.  Prosecutor Khan met with several leaders including Faustin-Archange Touadéra, President of the Central African Republic, and Félix Tshisekedi, President of the Democratic Republic of the Congo. [February 6, 2022]

ASIA

Bangladesh | ICC Prosecutor visits Bangladesh to address the Situation in Bangladesh/Myanmar 

ICC Prosecutor Karim A. A. Khan visited Bangladesh to address the Situation in the People’s Republic of Bangladesh/Republic of the Union of Myanmar.  During the visit, the Prosecutor met with national authorities including Prime Minister Sheikh Hasina and Foreign Secretary Masud Bin Momen.  The investigation into the Bangladesh/Myanmar Situation was requested by the Office of the Prosecutor in July 2019 and authorized by the Pre-Trial Chamber III in November 2019. [February 14, 2022]

THE AMERICAS

Columbia | President of Colombia visits the International Criminal Court

On February 17, 2022, the President of the Republic of Colombia, Iván Duque Márquez, visited the ICC and reaffirmed Colombia’s commitment to the ICC and expressed his admiration for the ICC’s work.  This follows ICC Prosecutor Karim A. A. Khan’s visit to Colombia in October 2021, when the Office of the Prosecutor and the Government of Colombia signed a cooperation agreement. [February 17, 2022]

Bolivia | Situation in Bolivia does not meet criteria for opening investigation

The Government of Bolivia referred the Situation in Bolivia to the Office of the Prosecutor in August 2020.  The referral alleges crimes against humanity occurred as a result of road blockades in August 2020 that restricted vital medical access leading to the death of over 40 people.  The Office conducted a preliminary examination and concluded that there is no reasonable basis that crimes within the ICC’s jurisdiction occurred.  Therefore, the Office of the Prosecutor considers that the Situation in Bolivia does not meet the criteria for opening an investigation. [February 14, 2022]

AFRICA

Central African Republic | Trial Chamber schedules opening date for Said case

The ICC Trial Chamber IV scheduled the trial of the case The Prosecutor v. Mahamat Said Abdel Kani to begin on September 26, 2022.  On December 9, 2021, Pre-Trial Chamber II confirmed charges against Mr. Mahamat Said Abdel Kani of war crimes and crimes against humanity committed in the Central African Republic in 2013. [February 21, 2022]

Kenya | Gicheru case trial opens

On February 15, 2022, the trial for the case The Prosecutor v. Paul Gicheru opened before the ICC Trial Chamber III.  Mr. Gicheru is facing charges as a co-perpetrator for offenses against the administration of justice between April 2013 and September 2015.  Mr. Gicheru pled not-guilty to all charges.  ICC Deputy Prosecutor, James Stewart, is appearing before the Court, as Prosecutor Karim A. A. Khan recused himself from the case. [February 15, 2022]

Uganda | Hearing held for the Defense’s Appeal in the Ongwen case

Between February 14 and 18, the ICC Appeals Chamber held hearings for the case The Prosecutor v. Dominic Ongwen.  In February 2021, Mr. Ongwen was found guilty of 61 crimes against humanity and war crimes committed between 2002 and 2005 in Northern Uganda.  The Defense is now raising 101 grounds for appeal which include legal, factual, and procedural errors relating to the conviction and the sentence.  This is the largest appeal in ICC history and raises many new issues for the Chamber to consider.  These initial hearings are for the Chamber to hear the parties and legal representatives address the Defense’s grounds for appeal.  Several amici curiae submitted observations and participated in the hearing.  This included PILPG co-founder Michael Scharf, who delivered remarks on PILPG’s amicus curiae observations to the Chamber.  Milena Sterio and Jonathan Worboys represented PILPG at the Chamber’s question and answer session. Côte d’Ivoire | ICC Chamber rejects Mr. Blé Goudé’s request for compensation

In 2019, the ICC Trial Chamber I acquitted Mr. Blé Goudé of charges of crimes against humanity occurring between December 2010 and April 2011 in Côte d’Ivoire.  Mr. Blé Goudé requested compensation under Article 85(3) of the Rome Statute.  Article 85(3) outlines that the ICC may award compensation where “there has been a grave and manifest miscarriage of justice.”  The Article 85 Chamber reviewed the instances where Mr. Blé Goudé alleges wrongful prosecution, and did not find “grave and manifest miscarriage of justice.”  Therefore, the Chamber rejected Mr. Blé Goudé’s request for compensation. [February 10, 2022]

Mali | Legal Representatives of Victims makes opening statements in the Al Hassan case  

On February 8, 2022, the Legal Representatives of Victims (LRV) made opening statements in the case The Prosecutor v. Al Hassan Ag Abdoul Aziz Ag Mohamed Ag Mahmoud. The LRV described how the 1,946 victims participating in the proceedings faced violations of their fundamental rights including sexual violence, arbitrary arrests and judgements, and some women continue to face socio-economic and financial harm. Mr. Al Hassanis facing charges of crimes against humanity against the civilian population from April 1, 2013 to January 28, 2013. [February 8, 2022]

Monthly News Updates: International Criminal Court – January 2022

In January, the ICC held a special session to open the 2022 judicial year.  The session reflected on the last 20 years of the Court’s work and discussed its work for the coming year.

INTERNATIONAL CRIMINAL COURT

ICC opens the 2022 judicial year

On January 20, 2022 the ICC opened its 2022 judicial year with a special session.  In his opening speech Judge Piotr Hofmański said the session was to briefly commemorate what the Court has done, but most importantly to focus on what the Court will do in the new year.  Due to COVID-19 restrictions, most judges attended virtually, and the event was live streamed and recorded. [January, 20, 2022]

ICC Prosecutor addresses UN Security Council on the Situation in Darfur

Pursuant to UN Security Council Resolution 1593 (2005), ICC Prosecutor Karim A.A. Khan addressed the UN Security Council on the Situation in Darfur.  Prosecutor Khan discussed the progress the ICC has made.  This includes confirming 31 charges against Mr. Abd-Al-Rahman (also known as Ali Kushayb) and setting the trial to start April 2022.  The ICC is conducting outreach to ensure the Sudanese population can follow the trial.  The Office of the Prosecutor is also strengthening the cases against Mr. Al Bashir and Mr. Hussein, but it requires stronger cooperation from Sudan, the UN Security Council, and UN member states.  Prosecutor Khan ended by emphasizing the ICC’s “unwavering commitment” to honor the UN Security Council’s Resolution.
