PILPG Commentary on the International Criminal Court Office of the Prosecutor’s
Policy on Children
The Public International Law & Policy Group appreciates this opportunity to provide comments in response to the Office of the Prosecutor’s call for suggested changes to build upon, and renew, the 2016 OTP Policy on Children.
In 2016, the ICC’s office of the prosecutor (OTP) published the Policy on Children, affirming its commitment to addressing crimes against or affecting children and providing guidance to staff on the interpretation and application of the Statute and Rules. The 2016 Policy aimed to ensure the interaction with children is sensitive and respects their best interests and rights under international law, foster a culture of good practices, and contribute to the development of international jurisprudence in this area. Recognizing the evolving nature of this field, the OTP initiated a call for public submissions in March 2023 to build upon and renew the 2016 Policy. We welcome the OTP’s call for engagement with its policy on children and are pleased to be part of the discussion.
